Affidavit

  I.

After careful consideration, I am aware of no circumstances that could justify the assumption that I fall under the definition of “Jew” according to  §§ 1 and 2 of the Laws of 24. 7. 1940 regulating  Jews in the Generalgouvernement

The revised §§ 1 and 2 are:

§1 As used in the Basic Laws of the Generalgouvernement, the term “Jew” is to be understood as follows:

          1. one who is a Jew or qualifies as a Jew according to the laws of the Reich;

          2. a former Polish citizen or stateless person who is a Jew or qualifies as a Jew in accordance with § 2 of this Regulation.

§2  A Jew is anyone who is descended from at least three fully racially Jewish grandparents.

 Someone who is descended from two fully racially Jewish grandparents qualifies as a Jew

a) if he has belonged to the Jewish religious community on 1 September 1939 or thereafter;

b) if he was married to a Jew at the time this Regulation came into force, or married one afterwards;

c) if he was the result of extramarital intercourse with a Jew in the sense of para. 1 and was born after May 31, 1941.

A grandparent is considered fully racially Jewish if he belonged to the Jewish religious community.

I have been advised of §156 of the Criminal Code of the German Reich, 15. 5. 1871, regarding the punishment for making a knowingly false affidavit.

After careful consideration, I am aware of no circumstances that could justify the assumption that I fall under the definition of “Jewish Mischling“ according to  §3 of the Laws of  24. 7. 1940  regulating  Jews in the Generalgouvernement.

The revised §3 is:

§3.  As used in the Basic Laws of the Generalgouvernement, the term “Jewish Mischling“ is to be understood as follows:

       1. one who is a Jewish Mischling according to the laws of the Reich;

       2. one who is former Polish citizen or stateless person who is descended from one or two fully Jewish grandparents, as long as he does not qualify as a Jew according to §2 para. 2.

The provision of §2  Paragraph 3 applies accordingly (cf. above)
